The makers of the film “Hellboy” have won their first victory in federal court in Hawaii. After a three-year legal battle, Magistrate Judge Kenneth Mansfield is now recommending a $150,000 default judgment against the foreign operator of former torrent site MKVCage.

Until a few years ago, MKVCage was a popular torrent portal that also uploaded its torrents to other sites.

It ended abruptly when the makers of the superhero movie “Hellboy” sued the site operator in the summer of 2019.

Film company HB Productions has accused the site and its Pakistani operator Muhammad Faizan of promoting and distributing pirated copies of the film, hoping this would put an end to the business. And indeed he did.

The lawsuit had an almost immediate effect as the torrent site became inaccessible shortly after the case was made public. At the same time, MKVCage also stopped pushing torrents to other sites. This meant that part of the plan had succeeded but HB Productions also wanted financial compensation.

Damages and Jurisdiction Battle

As Faizan failed to appear in court, the movie company’s attorney, Kerry Culpepper, requested a default judgment. Initially, the filmmakers sought $270,000 in damages for copyright infringement. This figure was based on the number of alleged infringements multiplied by the retail price of the Blu-ray.

The court was unconvinced by this calculation, and the film company later amended its claim to $150,000, which is the maximum statutory damages for copyright infringement for a single work.

Despite this change, Judge Mansfield was still not satisfied. He wondered if the accused, who had not presented a defence, could really be prosecuted in America. In 2020, the default judgment was dismissed based on the argument that a US court lacks jurisdiction over the Pakistani defendant.

The filmmakers were unhappy with this result and filed an amended lawsuit, hoping to correct the flaws in their claims. Initially, this renewed effort appeared to fail as Judge Mansfield consistently found the evidence provided insufficient. Last month, however, US District Court Judge John Michael Seabright came to a different conclusion.

According to the court, the Internet has transformed the way foreign defendants interact with the United States. In this case, the defendant used servers based in the United States from a remote location, which is sufficient to incur liability.

Judge recommends $150,000 in damages

With that decision in hand, the case was sent back to the magistrate judge who now recommends granting the default judgment of $150,000 as all the factors weigh in favor of the filmmakers. This includes the alleged damages, which are substantial.

“The Court finds that the amount of money involved is significant relative to the cost of continued litigation, particularly given the defendant’s location outside the United States and the plaintiff’s alleged actual damages totaling $270,902 $.58.

“The statutory damages sought by Plaintiff are appropriate and reflect the seriousness of Defendant’s willful infringement of Plaintiff’s copyrighted work,” Judge Mansfield added.

This means that a default judgment against the MKVCage operator is warranted but a separate assessment of the extent of damages is still required.

Here, Judge Mansfield also agrees that the maximum award of statutory damages is appropriate. These damages are intended to compensate the filmmakers, but also to punish the defendant.

Willful copyright infringement

The judge agrees that the offenses were intentional. Among other things, the site operator initially moved the site to a new domain when the lawsuit was filed.

“When the defendant received notification of this lawsuit, the defendant created a new website, ‘mkvcage.nl’, hosted by a completely different service […] so that the defendant can continue its infringing activities. »

Taken together, this means it is appropriate to award $150,000 in damages.

“The Court finds that an award of maximum damages under the Copyright Act is appropriate to deter and punish the defendant’s conduct and to compensate the plaintiff,” added Justice Manfield.

There is also a small disappointment in the recommendations as not all requested costs and fees have been granted. Nonetheless, the proposed award of $150,000 in damages is still a big win.

This means that after repeated back and forth, the film company can get most of what they asked for. The court has yet to adopt the magistrate’s recommendations, but the biggest hurdles have been cleared.

Along with the explosion of online piracy services over the past two decades, new anti-piracy companies have sprung up offering to quell the flames.

Most have their own specialties and target markets, with some even claiming to be 99% or 100% effective in one area or another. The reality is that no sane person invests time and money in a company whose mission is to ensure their own demise.

Anti-piracy services are effectively the weed killer and deodorizer of the internet – they can leave everything clean and fresh today, but there’s always a new and sometimes smelly infestation tomorrow. The battle never ends.

Nowadays, the fight against piracy is an integral part of the business strategies of entertainment companies. In the same way that Hollywood hires the best accountants to ensure that the least amount of tax is paid whenever possible, the removal of the availability of pirated content is considered essential in the quest for the greatest possible profit. To that end, filmmakers, record labels, TV companies, and movie chains need to hire more and more people to make it happen.

In the UK, there are currently more job vacancies than unemployed. This week, we scoured recruitment sites for interesting positions. We expected one or two in the anti-piracy market but, to our surprise, we found many, including some we didn’t expect to be mentioned in public.

Movies and Music

Given the size of its operation, it wasn’t much of a surprise to see Disney announce a role described as “Analyst, Digital Media Antipiracy.”

“This position will be part of a team responsible for providing anti-piracy services with a focus on combating online piracy of movies, television and live events related to Disney properties worldwide, working closely with industry associations, outside attorneys, and Disney businesses and legal teams.

“Duties for this position include supporting anti-piracy efforts, researching hacking technologies, websites and apps, tracking hacking data, providing regular reports on hacking trends, evaluating potential anti-piracy service providers and managing existing providers,” the listing reads.

Disney is looking for someone with a working knowledge of the DMCA, a business or computer science degree, and a “solid understanding of the landscape of online piracy sites,” including live streaming sites — both pirated and legitimate.

Disney isn’t publicly committing to a salary for this 12-month fixed-term contract, so if music is more your thing, Universal Music Group is also looking for a new hire.

Reporting to the Vice President of Global Content Protection for the company, the position of “Content Protection Representative” is one that the successful candidate may work from home. Supporting UMG’s global content protection strategies and helping to enforce UMG’s copyrights worldwide, the successful candidate will be familiar with anti-piracy and copyright issues and will speak a second language.

Knowledge of Blockchain, NFT (Non-Fungible Tokens) and Metaverse technologies is desirable for five days a week, Wednesday through Sunday. Like Disney, UMG prefers not to mention a salary for this position.

Site blocking gurus are needed

The position of Anti-Piracy Analyst is offered by the trademark protection/anti-piracy company Corsearch. The successful candidate will have previous anti-piracy experience, a good understanding of the piracy landscape (including BitTorrent and streaming), and excellent “web scraping” skills.

“Collect, collate, research and analyze data from a wide range of sources, including internal systems, to produce accurate, timely and complete records to facilitate the continued effectiveness of site blocking actions globally integer”, indicates the list.

Again, salary available is not mentioned, but given how important site blocking is to entertainment businesses, we assume this Cardiff-based position is paid with that in mind. Then, just like London buses, when one site blocking job comes along, suddenly there’s another.

Want pirate IPTV blocking?

Friend MTS, the anti-piracy company working with the Premier League to identify pirate IPTV streams so they can be blocked by ISPs, needs reinforcements in its team. The position of “Senior C++ Algorithm Engineer – Content Identification” suggests that the candidate will need to program a computer and be very, very good at adding.

“We are looking for an experienced and enthusiastic Software Engineer to join our expanding Content Identification and Watermarking team working on automatic content recognition and covert video watermarking technologies in a real-time distributed anti-piracy system used by many many major global media companies from satellite/cable broadcasters to sports rights holders and movie studios,” says Friend MTS.

“The position requires people with commercial experience in C++, with a good understanding of how to approach complex and mathematically difficult problems in software engineering.”

Ami MTS prefers not to give a salary indication, but in recent weeks the company has advertised several other positions, so there could be more than one opportunity. The company has an office in central Birmingham close to several trendy bars – ideal for quenching thirst after the Premier League lockdown ended on Saturday. And the Sunday. And in the middle of the week.

MUSO needs an anti-piracy chief

Anti-piracy firm MUSO regularly hits the news with piracy reports and analysis and at the end of last month began the process of recruiting a new ‘content protection officer’. Candidates will need a solid understanding and experience of the anti-piracy industry for digital content.

“This varied role will be responsible for line management of the content protection team, project delivery, client interaction and process development,” the announcement reads.

MUSO is offering a salary of up to £55,000 a year and the successful candidate will be able to work from home while trying out the company’s four-day working week trial.

This forward-looking work program is also available for a new ‘data analyst’ who, for up to £40,000 a year, will help media rights holders, broadcasters and VOD platforms to ‘understand the global demand for movie and TV titles, unearthing emerging trends and hitting titles that previously flew under the radar.

Fighting Movie Camming on the Front Lines

Finally, positions are available at Cineworld, the second largest cinema company in the world. Both require employees to monitor customers to make sure they aren’t hacking the latest blockbusters. If cameras are discovered, they should be dealt with in accordance with Cineworld’s Anti-Piracy Policy. If necessary, “appropriate measures” must be taken.

When not on the front line fighting piracy, candidates will need to monitor picture quality, sound quality, and screen temperature. Eyes should also be alert to any disturbance from customers, but if they complain, customers should be treated politely.

In addition to being passionate, resourceful and confident in communications, the successful candidate will be expected to promote membership programs to customers – when not working behind the bar or handling food in the kitchen, of course. An ability to work under pressure is an understandable requirement – the job also requires the daily cleaning of restrooms, back and front areas of the house, screens and cinema seats.

This important job in the film industry pays the princely sum of £10.05 an hour and the job of supervisor pays just 50p more.

Given that one of these positions is in Epsom, Surrey, where renting a one-bedroom apartment costs at least £250 per week, the successful candidate could end up with just £20 per day for survive, barely covering food and utility bills. in today’s environment. This may at least partly explain why the UK has so many vacancies at the moment.

That being said, Cineworld has billions in debt, so things could be worse.

Many years ago, I was giving speeches to groups to let them know that the internet was not a fad and that it would have a real impact on everyone’s life.

But I hadn’t anticipated the current state of the internet.

I had always thought of it as the classic “information highway” it was meant to be.

Little did I and others know that a real revolution that would turn our whole world upside down was about to happen.

The Internet, as a global communications network, has delivered on all the promises of the information highway and more. Today, we carry in our pockets a device that puts the sum total of human knowledge within reach.

It heralded a golden age of progress in the arts and sciences, eclipsing all our previous achievements. However, no technology is neutral.

For example, guns can be used to hunt for food, but they can also be used to kill our fellow human beings. Indeed, the Internet has brought us scientific achievements beyond our dreams, disseminated the arts, given voice to private ideas, and allowed it to proliferate. It also brought a plethora of bad results.

It has been used to subvert our democracies, spread deadly misinformation and confuse people about what is fact. This has allowed conspiracy theorists of all kinds to flourish and spread their lies to an audience seemingly ill-equipped to interpret what is true and what is false.

The Internet has upended our usual ways of doing business. Movies are pirated, books are shared online, and newspapers and electronic media, while trying to adapt to the new paradigm, have seen their credibility and financial viability strained by the torrent of misinformation.

Totalitarian governments view the Internet as a golden opportunity to invade people’s privacy with unprecedented ease. A riot would be triggered if a government mandates a tracker to report a person’s every move, what they read and who they talk to. However, most people carry cellphones, which have the ability to do just that and we thoughtlessly accepted it.

We are often willing to trade privacy for convenience. Governments try to scare us into allowing such surveillance under the guise of law and order – to keep criminals away from honest people.

Special secret courts have been set up to ensure the protection of people’s rights. But since the deliberations of these tribunals are secret, who knows what they are doing? Certainly not the public.

The Romans had a Latin phrase that suited this situation perfectly: “Quis custodiet ipsos custodes? Translated, this means: “Who watches the watchers?” The answer is nobody.

Privacy can be a matter of life and death as whistleblowers and activists struggle to spread the word in the face of authoritarian governments. One of the tools they use is a virtual private network, or VPN, which disguises your internet activity. These systems are inexpensive and work exceptionally well in encrypting your traffic between sites, as well as acting as a relay point for your internet traffic.

This is the same type of system you use to do your internet banking.

VPN providers are meant to be trusted third parties that do not keep logs of sites you visit or talk to. Unfortunately, some have been caught keeping logs and selling the information to companies for marketing purposes.

Governments, too, have stepped in and pressured VPN providers, even requiring them to keep logs and turn them over in response to police or court orders.

While the safeguards above can help, privacy always loses when governments attempt to control their populations.

The Internet has given them a golden opportunity to do so. Who watches the watchmen?

Anti-piracy coalition ACE has scored yet another victory by shutting down We-Play, one of Thailand’s biggest piracy portals. Local police raided Bangkok and arrested the alleged site operator. We-Play allegedly “caused” $1.2 million in losses per month, which translates to $0.50 for each visit to the site.

There’s no denying that the Alliance for Creativity and Entertainment (ACE) has done quite well in recent years.

The anti-piracy group, which represents leading rights holders such as Disney, Netflix, Warner Bros and beIN, systematically tracks down major piracy players.

These enforcement actions led to the disappearance of high profile targets including Openload, RapidVideo, Pelisplushd.net, Afdah.video and many others. This week we can add another name to the growing list.

ACE reports that together with local rights holder True Visions, it helped Thai police shut down We-Play.live. The site offered a wide variety of pirated content, including movies, TV shows, and sports. He reportedly generated revenue through subscriptions and ran advertisements for illegal gambling operations.

The Royal Thai Police’s Economic Crimes Suppression Division raided a condo in Bangkok where the 26-year-old site operator was arrested. He will be prosecuted on charges related to copyright infringement.

Jan van Voorn, head of global content protection at ACE, is pleased with the result. He hopes this will send a clear signal to other site operators in the region that hacking is not tolerated.

“ACE commends Thai police for their continued collaboration and effective takedown of this infamous streaming website,” van Voorn said. “The operator of the We-Play site network deserves a trial.”

We-Play had been in business for four years and had around 2.8 million visits per month according to ACE, citing data from SimilarWeb. However, according to True Visions and local news reports, the site had “only” 20,000 visitors per month.

Despite this confusion, all sources agree that the site caused around 50 million Thai baht ($1.4 million) in damage per month. This estimate is based on information provided by the local police.

With 20,000 visitors, that would mean that each visitor causes $70 in damages to rights holders. And even at 2.8 million monthly visits, each visit would take $0.50 from the rights holders’ coffers, which is still quite high.

In the wake of We-Play’s shutdown, Thai police also shut down the pirate IPTV service pglivetv.com.

With the support of ACE and True Visions, several servers were seized from local host World Internetwork. The 37-year-old operator of the IPTV subscription service was arrested at a residence in Bangkok, where a number of documents and devices were also seized.

Dutch ISP Ziggo doesn’t have to send a hacking warning to a subscriber accused of offering 200 e-books in an open directory. Anti-piracy group BREIN took the case to court which found, for the second time, that ISPs needed a license to process the personal information of alleged infringers.

Backed by Hollywood and other content industries, Dutch anti-piracy group BREIN has shut down hundreds of pirate sites and services in recent history.

BREIN has also successfully targeted several prolific BitTorrent downloaders and other offenders. Tracking down and prosecuting individual file sharers is resource-intensive, however, and the anti-piracy group aims to expand its network.

Send warning letters to hackers

To expand its reach, the group previously obtained permission from the Dutch Data Protection Authority to track and store the personal data of alleged BitTorrent hackers. This request was accepted and at the end of 2020, BREIN announced the start of its mass alert campaign.

Unlike other copyright enforcement groups, BREIN is not interested in casual pirates. Instead, it focuses on the biggest fish and asks ISPs to issue a warning to those subscribers.

This sounds like a balanced approach that would be relatively easy to implement in many other countries where forwarding hack notices is standard procedure. In the Netherlands, however, it is not at all simple.

Ziggo refuses to transmit, the court accepts

When BREIN sent its warnings to the nation’s largest ISP, Ziggo, the company refused to forward the warnings to its subscribers. According to Ziggo, linking IP addresses to specific subscribers raises serious privacy concerns, even if personal information is not shared with BREIN.

In February this year, the court in Utrecht sided with the internet service provider. Although BREIN has a license to process the personal information of alleged infringers, Ziggo does not. This means that linking an IP address to subscriber information would violate Dutch privacy law, which is based on the European GDPR.

It was a severe setback for the anti-piracy group. This effectively makes it impossible to alert subscribers that their connection is being used to share copyright-infringing content, even if that personal information is not transmitted. BREIN didn’t give up either.

The ground doubles

The anti-piracy group submitted another case. This time, a Ziggo subscriber was accused of offering more than 200 e-books to the public through an open directory. BREIN hoped that the ISP would provide notice to the associated account holder or share their personal data.

This week, the court in Utrecht ruled that the ISP was not obliged to cooperate with this request. Without a license from the Dutch Data Protection Authority, linking the IP address to subscriber information would violate privacy law. For the same reason, it also cannot share subscriber details directly with BREIN.

Even if Ziggo had been allowed to process the data, BREIN would not have prevailed. The court concluded that there was insufficient evidence to show that the subscriber voluntarily made the books available for others to download. It is possible that they were simply put online for personal use, without adequate protection.
